Acceptance of Terms
By accessing this website, requesting a quote, or booking any service with Aviira Drone Solutions, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
Services
Aviira Drone Solutions provides professional aerial photography, video, and documentation services as described on our website. All services are subject to availability, weather conditions, and airspace authorization. We reserve the right to reschedule any shoot due to unsafe flying conditions, restricted airspace, or circumstances beyond our control.
Client Responsibilities
The client is responsible for providing accurate project details, including the property address, requested shoot areas, site access information, known hazards, desired deliverables, and any relevant deadlines. The client is responsible for obtaining permission from the property owner or authorized representative for Aviira Drone Solutions to access and photograph the property, unless otherwise agreed in writing. The client must notify Aviira Drone Solutions of any site restrictions, active construction areas, animals, security systems, private events, sensitive areas, or other conditions that may affect safe or lawful operations. If Aviira Drone Solutions is unable to complete a shoot due to inaccurate information, lack of access, lack of permission, undisclosed restrictions, unsafe site conditions, or other client-side issues, additional fees may apply for rescheduling or return visits.
Bookings and Payment
Deposits may be required to reserve a shoot date and may be applied toward the final project cost. Final payment is due upon delivery of completed files unless otherwise agreed in writing. Pricing is subject to change; any quoted price is valid for 30 days from the date of the quote. Client cancellations made at least 48 hours before the scheduled shoot may receive a refund of the deposit. Weather, safety, airspace, or operational rescheduling by Aviira Drone Solutions will not cause the client to forfeit the deposit.
Cancellations and Rescheduling
Client cancellations made at least 48 hours before a scheduled shoot will receive a full refund of any deposit. Client cancellations made with less than 48 hours notice may result in forfeiture of the deposit. Weather, safety, airspace, or operational rescheduling by Aviira Drone Solutions will not cause the client to forfeit the deposit. We will make every reasonable effort to accommodate rescheduling requests at no additional charge.
Weather, Safety, and Airspace
Aviira Drone Solutions monitors weather, airspace, and site conditions prior to every shoot. We reserve the right to postpone or cancel any operation if conditions are deemed unsafe or unlawful. Unsafe conditions may include, but are not limited to, precipitation, high winds, poor visibility, nearby hazards, restricted airspace, or unsafe takeoff and landing areas. Rescheduled shoots due to weather or safety will be accommodated at no additional charge to the client.
FAA Compliance
All drone operations are conducted in accordance with FAA Part 107 regulations. Some locations may require FAA airspace authorization or additional operational review. If required authorization cannot be obtained in time for the scheduled shoot, the project may be rescheduled or cancelled without penalty to Aviira Drone Solutions. We reserve the right to cancel, delay, modify, or terminate any drone operation at any time if, in our sole judgment, the operation cannot be conducted safely, legally, or in compliance with FAA regulations. Final flight decisions are made by the remote pilot in command.
Deliverables and Delivery Timeline
Final edited photo deliverables are typically delivered within 2-3 business days of the shoot date. Video, larger projects, or more complex deliverables may require additional time unless otherwise agreed in writing. Delivery timelines may vary based on project scope, complexity, and volume. Deliverables are provided via secure cloud link. Aviira Drone Solutions is not responsible for delays caused by client-side access issues, incorrect contact information, or circumstances outside our control. While Aviira Drone Solutions will make reasonable efforts to capture requested images, angles, and subject matter, we do not guarantee any specific shot, angle, lighting condition, weather condition, or visual result unless expressly agreed in writing. Clients are responsible for downloading and saving delivered files after delivery. Delivery links may not remain active indefinitely. Aviira Drone Solutions is not responsible for storing delivered files permanently unless otherwise agreed in writing.
Revisions and Raw Files
Unless otherwise agreed in writing, each project includes one reasonable round of revisions to final edited deliverables. Additional revisions, re-edits, or changes outside the agreed scope may require an additional fee. Raw files, unedited images, unedited footage, flight logs, project files, and editing files are not included in standard deliverables and are not available unless expressly agreed in writing prior to the shoot.
Intellectual Property and License
Upon receipt of full payment, the client receives a non-exclusive, non-transferable license to use the final delivered images and video for the purposes agreed upon at booking, including website, social media, internal documentation, marketing, and promotional use unless otherwise stated in writing. Aviira Drone Solutions retains all copyright ownership in the original and delivered media. The client may not sell, sublicense, transfer, or provide the media to third parties for resale or unrelated commercial use without written permission from Aviira Drone Solutions. The client represents that they have the right to request photography or video services at the project location and that the use of delivered media as requested by the client will not violate the rights of any third party.
Portfolio Use and Confidentiality
Aviira Drone Solutions may use delivered media for portfolio, website, social media, marketing, advertising, and promotional purposes unless the client requests confidentiality in writing before the shoot and Aviira Drone Solutions agrees to that request in writing.
Visual Documentation Disclaimer
Aviira Drone Solutions provides visual aerial documentation only. We do not provide roof inspections, structural inspections, engineering evaluations, code compliance reviews, damage assessments, or professional opinions regarding the condition, safety, or integrity of any structure or property. Clients should consult qualified inspectors, engineers, contractors, or other licensed professionals for professional evaluations. All media reflects only visible conditions at the time of capture.
Limitation of Liability
Aviira Drone Solutions shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or delivered media. Our total liability for any claim arising out of or relating to a project shall not exceed the amount paid by the client to Aviira Drone Solutions for that specific project.
Indemnification
The client agrees to indemnify and hold harmless Aviira Drone Solutions from claims, damages, liabilities, costs, or expenses arising from inaccurate information provided by the client, lack of property permission, unsafe site conditions not disclosed to Aviira Drone Solutions, misuse of delivered media, or the client's use of Aviira Drone Solutions' services in violation of these Terms or applicable law.
Governing Law
These Terms of Service are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising under these terms shall be resolved in the courts of Massachusetts.
Changes to Terms
We may update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.
